In partnership with the Australasian Railway Association and Lloyd’s List Australia, Informa are delighted to be running our 15th AusIntermodal Conference in Sydney in November.The agenda will cover a range of issues affecting containerised freight in Australia including; planning, funding and efficiency. One of the most important topics set to be examined during the two day Conference is the Intermodal Chain of Responsibility.
The Chain of Responsibility Laws are not new but the logistics sector still have some work to do to ensure a blanket understanding of everyone’s responsibilities and obligations. A thorough understanding is essential considering the Chain of Responsibility touches all participants along the supply chain.
Nathan Cecil, Partner at Holding Redlich, will cover this important topic at the Conference. In the lead up to the event Nathan, a specialist in international trade and transport, shipping, maritime, logistics, commodities and offshore industries and winner of the Australian Rising Star Shipping Lawyer of the Year in the 2014, gave us a few minutes of his time to discuss the topic and the conference itself.
Nathan, tell us a bit about your background and your work with Holding Redlich
I have specialised in transport and logistics law since I started working as a lawyer more than 10 years ago. I help shipping, logistics, road transport, commodities and manufacturer/distributor businesses with commercial transaction and document structuring, regulatory compliance and dispute resolution. The fact that my work covers from getting projects and transactions off the ground right through to disputes at the end has given me a great overview of the commercial operations of the sector from start to finish. Working across the different modes of transport has also given me an appreciation of the importance of commercial and regulatory cooperation and consistency along the logistics supply chain – each mode has to link with the others and if one is operating in isolation without an appreciation of how it is connected to the others, the chain kinks.
The Chain of Responsibility laws are not new, but awareness and understanding in the logistics sector still has a long way to go. The regulators have announced that their focus is on driving the compliance message right up and down the chain, so now is the time to get compliance practices in order.The biggest perception shift required is to realise that the chain is a continuum. What others along the chain do (or don’t do) can affect your compliance. Just as intermodal operations need to be aligned for a smooth flow along the logistic supply chain, Chain of Responsibility compliance practices need to be aligned right along the chain as well. So far, the individual modes of transport are mainly addressing their own compliance. The compliance field of vision needs to be expanded to take in the operations of your business partners and customers as well.
My presentation will cover the obligations of parties along the intermodal freight chain, tips for ensuring compliance across the junctures of the different modes of transport and give a heads up about new mandatory container weighing rules which are going to come into force in July 2016.
What are you looking forward to most about participating in AusIntermodal 2015?
I am looking forward to getting a great overview of the commercial and legal state of play in the intermodal sector. Intermodal transport hubs are where it all comes together. They are the nexus for complex operations and legal and compliance requirements. The programme looks like it should offer a great overview of the sector and provide some insight into future directions.
