About the Course

The Diploma in Maritime Law from North Kent College in partnership with Lloyd’s Maritime Academy delivers a detailed understanding, commercial awareness and practical application of the main principles and concepts that make up maritime law and which may impact day to day work in the maritime industry.

Those in the maritime industry often face legal issues that have international dimensions because the ship, its ownership and/or crew are usually multi-national. The legal issues arising are often complex so it is important to understand how best to tackle and what can be achieved.

Course Leader

Melis Ozdel

Melis is an expert in Shipping, International Trade Law, Conflict of Laws and Jurisdiction and International Commercial Arbitration. She is the specialism convenor for Maritime Law studies at UCL, and director of the UCL Centre for Commercial Law. Alongside her academic life, Melis is also a consultant lawyer at Birketts LLP, and she takes instructions on legal matters in these fields, including:

  • Cargo claims (under bills of lading or other types of transport documents)

  • International sale of goods

  • Marine Insurance
  • International commercial arbitration
  • Sale of ships
  • Shipbuilding contracts

Melis is the editor and co-author of Commercial Maritime Law (2020, Hart Publishing), author of Bills of Lading Incorporating Charterparties (2015, Hart Publishing) and co-author of EU Transport Law (2016, Hart-Nomos-Beck). She is also the founder of the UCL Autonomous Shipping Project, which was launched in a bid to start an open and diverse debate on the future of autonomous shipping from a legal perspective. The project has a website (https://ucl-autonomous-shipping.org).

At UCL, Melis convenes the two core shipping modules, carriage of goods by sea and international trade law, and co-convenes the international arbitration law module. She also delivers seminars to legal professionals and those working in the shipping and trade industry.

Melis is a member of the Chartered Institute of Arbitrators, a supporting member of the LMAA (London Maritime Arbitrators’ Association), and a member of the CMI (Comite Maritime International) Working Group on Unmanned Vessels.

North Kent College

PROFESSIONAL DEVELOPMENT ASSESSED AND AWARDED BY NATIONAL MARITIME TRAINING CENTRE AT NORTH KENT COLLEGE

The National Maritime Training Centre is based on the River Thames at Gravesend and is part of North Kent College. Formerly the Gravesend National Sea Training College, the Centre has a long heritage in the training of seafarers and shore-side personnel and remains a major provider of education and training services to the maritime industry. The Centre is approved by the UK Maritime & Coastguard Agency to issue STCW certificates of competency.

The College is at the forefront of the provision of further and higher education in the south east of England. It caters for more than 4,500 full-time students across two main campuses, with a wide variety of academic and vocational courses, as well as professional education and training via short courses, part-time study or distance learning. Full-time and part-time higher education programmes and foundation degrees are delivered via a partnership with the University of Greenwich.

Module 1
Introduction to Maritime Law

The course starts with an introduction which explains the wide scope of maritime law, which is then expanded in the later modules. It considers the body of law governing marine commerce and navigation, the carriage at sea of goods, and marine affairs in general; the rules governing contract, tort, and workers’ compensation claims or relating to commerce on or over water.

Module two explores the key conventions and regulations that impact on the operation of the maritime industry, how they are set and how compliance is achieved.

Module 3
Charterparties

The module explores the two main forms of charterparty, namely voyage and time charterparties, entered into between a shipowner and a “charterer”. It discusses the rights and responsibilities of shipowners and charterers, and how any subsequent dispute between them are settled in the courts of law or other forum (e.g. arbitration).

  • Discuss how the sea carriage risks are allocated between shipowners and charterers under charterparties.

Module 4
The Carriage of Goods under Bills of Lading

Module four focuses on the Law of Carriage of Goods by Sea under Bills of Lading and other types of transport documents (such as seaway bills and ship’s delivery orders). This is the body of law that governs the rights and duties of shippers, carriers, and consignees of marine cargo.

Module 5
Admiralty Law

This module covers the key aspects of Admiralty Law and the rules governing ownership, possession, and physical operation of commercial ships along with workers’-compensation claims arising out of commerce on or over navigable water. It also deals with the rules of jurisdiction and how the courts exercise jurisdiction over all maritime contracts, torts, injuries, or offenses.

Ship and Crew Management

Owners can either operate their ships themselves or engage independent third-party managers. Whoever undertakes this role has a wide range of policies to address, which are explored into this module.

This module deals with the key aspects of marine insurance, covering in particular hull and machinery policies, the governing legislation (the Marine Insurance Act and the Insurance Act), broking and underwriting, claims handling and subrogation.

Module 8
Ship Construction, Sale and Purchase, Repair and Ship Recycling

When ships are built, purchased second-hand, sold, repaired and eventually scrapped and recycled, there are a myriad of legal issues. This module considers these, along with the legal contracts that are used.

Maritime Fraud

The module considers the legal use of how the maritime industry seeks to combat all forms of commercial crime, including commercial crime; fraud in international trade, insurance fraud, financial instrument fraud, money laundering, shipping fraud and product counterfeiting.
